Scammers targeting Burnet utility customers by phone

BURNET — City officials are warning residents about a potential scam involving utility payments.

The Burnet Police Department has received calls regarding a utility bill scam in which a person calls a resident and tells him or her that his or her bill is past due and the city is on the verge of cutting off those services. The caller tells the person the only way to stop this is by going to a store and purchasing a “Green Dot Card.” Then, the resident must provide the card information to the scammer.

The scammer tells the resident this is the only way his or her account can be brought up to date.

A “Green Dot Card” is basically a pre-paid debit card that makes it extremely difficult for law enforcement to track the transaction.

Burnet officials said they never call a resident demanding payment over the phone. Instead, the city sends out past-due notices on the 21st of each month.

Residents should never give out personal banking information to someone they don’t know over the phone, officials said. Citizens can check the status of their utility account either online at www.cityofburnet.com by clicking “Online Services” and using the secure log-in or by calling (512) 756-6093.

Citizens who have received a call or a suspicious notice should call the police department at (512) 756-6404.

Alert Marble Falls officer nabs suspects in wire theft

MARBLE FALLS — A Marble Falls police officer who noticed a vehicle parked at the Verizon substation in the 900 block of Second Street might have thwarted an alleged theft of copper wire.

Officer Tina Harvey was on routine patrol when she observed the vehicle just before midnight Jan. 3. When the driver of the vehicle saw her, he drove off, according to Marble Falls Police Capt. Glen Hanson.

“He wasn’t racing off, but it was one of those things where he saw her, and she saw him and he quickly drove off,” Hanson said. The vehicle’s registration sticker had expired, giving the officer reason to stop the car.

Inside, Harvey identified two men dressed in dark clothes with dirty hands and in possession of bolt cutters. She also found a big bundle of copper wiring in the vehicle.

While Harvey detained the two men, another Marble Falls officer went to the Verizon location, where he found the fence was cut. Hanson said the location of the breach was in an area not easily seen from the road.

“She took the two into custody,” Hanson said. “The next day, a Verizon representative was able to identify the wire (found in vehicle) as from their supply.”

This was done based on identifying marks on the copper wire, Hanson said.

The wire, if sold as scrap, was worth about $750.

Officers charged Blake Wade Meador, 40, and John Lynn Mezger Jr., 28, with theft of material-aluminum/bronze/copper/brass of less then $20,000 and unlawful use of a criminal instrument.

Hanson explained the unlawful use of a criminal instrument was applied because the suspects allegedly used the bolt cutters in a criminal manner to cut throug the fencing.

Both men were booked into the Burnet County Jail. Meador was released Jan. 6 after posting $7,500 in surety bonds while, as of Jan. 9, Mezger was still being held in lieu of $7,500 in bonds.

Paul Devoe’s appeal denied; convicted murderer also charged in Marble Falls killing

AUSTIN — The Texas Court of Criminal Appeals rejected an appeal from convicted murderer and death-row inmate Paul Devoe.

The decision, released Jan. 15, means Devoe’s 2009 murder conviction and death sentence remain in place. Devoe was charged with murdering six people in 2007 including Marble Falls bartender Michael Allred after the bartender intervened when Devoe attempted to shoot a woman at O’Neill’s Sports Tavern on Main Street.

Devoe never went to trial for Allred’s murder. But he was convicted of killing 15-year-old Haylie Faulkner and 17-year-old Danielle Hensley on Aug. 24, 2007 at a Jonestown home after fleeing from Marble Falls.

He also was charged in two more deaths at the Jonestown residence: his ex-girlfriend Paula Griffith and her boyfriend Jay Felter.

Devoe then fled Texas to his native Long Island, N.Y., where he was eventually arrested. But authorities in Pennsylvania also charged Devoe with murder. According to authorities, while traveling from Texas to New York, Devoe had car trouble in Pennsylvania, where he allegedly killed 81-year-old Betty Dehart in her home and stole her car.

Devoe, 50, currently sits on death row at the Texas Department of Criminal Justice’s Allan B. Polunsky Unit in Livingston.

The Court of Criminal Appeals is the highest court for criminal cases in Texas.

BURNET — Darlene Jackson, 18, was a Burnet High School senior who, like many of her classmates, was probably looking forward to graduation in the spring of 2013. But the student, who also worked part time at the Crazy Gal’s Cafe in Burnet, never walked across the field at Bulldog Stadium.

On Oct. 27, 2012, Jackson was found dead in her home. Officials later ruled her death was from an heroin overdose.

About 14 months later, the Burnet County Grand Jury indicted two people in connection with Jackson’s death for their role in providing her with the heroin that would eventually take her life.

Kyley Denton Wills, 23, and Paige Amanda Moffett, 21, face third-degree manufacture/delivery of a controlled substance charges for allegedly providing the heroin to Jackson the day before her death. But prosecutors believe they didn’t just provide it, they were there with Jackson when she used the drug, possibly using it themselves.

“Basically, what this case is about is the delivery of heroin that occurred on the 26 (of October 2012); then, there appeared to be a group use of the heroin,” said Burnet County Assistant District Attorney Richard Crowther. “Then, it turned out an 18-year-old lady died of the heroin.”

Officials don’t know if the two suspects were present when Jackson died.

Crowther said, under typical drug delivery situations, a charge of delivery of this amount and type of illicit material would have warranted a state jail felony charge, which draws less punishment. But with Jackson’s death attributed to the heroin, it ups the charge to a third-degree felony.

The two could face up to 10 years in prison and up to a $10,000 fine if convicted of the offense.

Crowther said, during his career, he has witnessed how drugs can destroy a person. Still, this case stands out.

“It’s unusual because we don’t have all that many people immediately die from the overdose,” he said.

With or without a death, Crowther said the district attorney’s office takes all drug delivery cases seriously.

“The controlled substance is poisoning, basically, the youth of our community,” he said.

Both Wills and Moffett were booked into the Burnet County Jail on Jan. 27 and being held in lieu of a $25,000 bond each. Moffett is also being held on an additional manufacture/delivery of a controlled substance charge out of Llano County, according to jail records.

Former firefighter gets 60 years for Spicewood murder in 2011

AUSTIN — A Travis County district judged sentenced a former Pedernales Fire Department firefighter to 60 years in prison Feb. 12 for the July 2011 murder of 22-year-old Veronica Navarro.

On Feb. 11, a Travis County jury deliberated for less than an hour before returning a guilty verdict against Joe Derek Carr, 29, for murdering Navarro and then attempting to dispose of her body.

In early July 2011, workers found Navarro’s body on the east side of Pace Bend Park in western Travis County. Her body was wrapped in a tent and weighted down with paint cans, Travis County sheriff’s investigators reported at the time.

A few days later, Carr was stopped at the Canadian border in North Dakota after Canadian authorities became suspicious of the man after he requested a tourist’s visa — something not required for U.S. citizens. Canadian officials contacted Travis County authorities and learned Carr was wanted for questioning in Navarro’s death. He was later detained by U.S. officials in North Dakota until he was returned to Travis County.

According to a 2011 Travis County probable cause affidavit, Carr and Navarro shared a residence in the 1200 block of CR 407 in Burnet County, just northwest of Spicewood. During a July 9 search of the residence, investigators found two gallon-size paint cans that had stickers matching cans found with Navarro’s body. Along with the paint cans, investigators found a part of a tent that matched the one in which Navarro’s body was wrapped, according to the document.

State District Judge Cliff Brown sentenced Carr’s terms to run concurrently.

BURNET — A Burnet County Grand Jury handed down first-degree engaging in organized crime indictments against seven people charged in December for their alleged involvement in a methamphetamine ring that spread across several counties and transported the illicit drug in from Mexico.

On Feb. 4, the grand jury indicted Jeremy Joseph Childers, 36; Kimberly Ann Weston, 38; Joy Ashley Perez, 28; Timothy Steven Blackard, 44; Christopher Castillo, 41; Cindy Brinkley, 46; and Charles Newman Smith Jr., 53.

If convicted, the suspects face up to 99 years or life in prison.

The indictments come from a six-month law enforcement investigation that involved Burnet County, state and national officials.

On Dec. 4, 2013, Burnet County sheriff’s deputies, Burnet police officers, Bertram police officers, Texas Department of Public Safety officers and U.S. Drug Enforcement Administration agents, along with other local agencies, initiated search and arrest warrants at a property in the Bertram area.

At the time, authorities announced the arrest of 15 people allegedly involved in the trafficking, storing and distribution of methamphetamines. The investigation lasted six months and spanned from Burnet County to the Mexican border.

Other arrests or individuals charged in the investigation have followed. Not everyone arrested during the initial raid was indicted, but Burnet County District Attorney Sonny McAfee said his office is still reviewing the cases, which could lead to more indictments.

Authorities said the methamphetamines seized during the investigation and allegedly sold by people involved came from Mexico. Officials said suspects at the Bertram residence were selling 4-5 pounds of the illegal drug each month during the course of the six-month investigation. Officers put the street value of the monthly amount at about $200,000.

Along with the December arrests, authorities seized more than 70 firearms, $10,000 in cash and more than 8,000 rounds of ammunition. The firearms included shotguns, rifles, handguns and at least one silencer. Officials also seized several pieces of body armor.

McAfee said the nature of the crime is bad enough, but adding the organized element makes it even worse.

“Anytime when people organize together to commit crimes, it affects the community, and we’re going to assist law enforcement in pursuing those offenders and prosecuting them,” the district attorney said.

Horseshoe Bay man faces capital murder charges in Spicewood deaths

BURNET — On Feb. 4, the Burnet County Grand Jury indicted a 35-year-old man in his alleged role in the murder of two Spicewood residents in May 2013.

Juston Aaron Curbow of Horseshoe Bay faces two counts of capital murder by terror or threat while committing another felony and capital murder of multiple persons in the May 15, 2013, deaths of Thomas Wells, 30, and Dorrina Reese, 42.

If convicted, Curbow could face the death penalty.

In August 2013, a grand jury indicted Curbow on first-degree felony arson charges in relation to the alleged crime. A second person, Melissa Frink, 34, also was indicted on a third-degree tampering with evidence charge in August for her alleged role in the crime.

A third person, 30-year-old Mark Currie, also was charged with the double homicide, but he was found dead in his Burnet County Jail cell May 18, 2013, after he apparently hanged himself.

On May 15, 2013, Spicewood Volunteer Fire Department crews along with Burnet County sheriff’s deputies responded to a report of a house fire in the 200 block of CR 425 in Spicewood. Firefighters found two bodies, later identified as Wells and Reese, in the home.

Burnet County deputies aided by the Texas Department of Public Safety Crime Scene Unit and other agencies arrested the three suspects the following day.

In an arrest warrant affidavit for Curbow, he allegedly confessed to investigators during an interview that Currie shot the two victims with a pistol after an argument. After the shooting, the affidavit stated Currie told Curbow to get a can of gas from the car, which he allegedly did and then poured some on the house’s floor.

But the suspect told investigators Currie actually lit the fire.

The document stated the entire episode began earlier May 15, 2013, after Frink and Wells got in an altercation. Currie, who as Frink’s boyfriend, was present at the time of the altercation.

Curbow is being held without bond in the Burnet County Jail.
