Burnet County Sheriff’s investigator faces perjury, evidence tampering charges

BURNET — A Burnet County Sheriff’s Office investigator faces felony charges after he allegedly made false statements during an investigation of stolen wiring that landed two people in jail.

On Nov. 5, the Burnet County Grand Jury indicted Irvin Boshears, 61, on aggravated perjury and tampering with/fabricating physical evidence. Both are third-degree felonies punishable by up to 10 years in prison.

According to the indictment, authorities allege Boshears stated he recovered some stolen property while executing a search warrant Aug. 29. Based on that information, he was able to get arrest warrants for two individuals: Lelon Brooks and Cecilia Graham.

The indictment, however, stated a piece of evidence, described as a “reel with a ‘U’ or horseshoe” brand was not seized during the Aug. 29 search but “recovered at an earlier date before the search warrant was executed.”

Boshears’ indictment centers around an investigation that began Aug. 9 when officials with Apex Drilling, located in the 5500 block of U.S. 281 north of Marble Falls, reported the theft of two reels of submersible wiring.

According to an arrest warrant affidavit signed by Boshears and presented to the justice of the peace Aug. 30, investigators obtained information from a confidential informant that led to identifying suspects in the theft as well as the location where the suspects stripped casings from the copper wiring.

Apex officials reported another theft Aug. 19. According to the affidavit, an informant told Boshears the same suspects were involved in this theft and again had stripped the wiring at the same location previously reported.

On Aug. 22, a deputy attempting to execute an arrest warrant for Brooks on an unrelated charge at the man’s residence reported seeing stripped copper wiring and stripped wire casings in plain view, according to the affidavit.

During the past several years, Apex suffered many thefts of wiring, and, as a result, officials and Boshears came up with a identifying mark, a branded U or horseshoe, to be placed near the center of the wooden spools or reels, the affidavit continued.

On Aug. 26, Boshears obtained a search warrant for the property in question and executed it Aug. 29. According to the affidavit, Boshears found submersible wire casings and other materials consistent with the items reported stolen from Apex.

One item Boshears noted recovering in the affidavit Aug. 29 was a reel bearing the U or horseshoe brand. According to the grand jury indictment, however, this piece of evidence was found before the execution of the search warrant, though in the affidavit, the investigator stated it was recovered Aug. 29 under the auspice of the Aug. 26 search warrant.

Under the guise of the arrest warrant affidavits, authorities arrested and charged Brooks and Graham with the theft of the wiring from Apex. According to Burnet Count Jail records, the charge against Brooks has been dropped, but the status of Graham’s charges could not be confirmed.

The perjury indictment alleges Boshears made a false statement in the arrest warrant affidavit he presented to the justice of the peace and information was used to “provide probable cause for the arrest of a person.”

Under the tampering charge, the indictment alleges Boshears knew the wood spool or reel had not been recovered during the Aug. 29 search but still offered it in such a way as “with knowledge of its falsity and with intent to affect the course or outcome of the investigation.”

Boshears was booked into the Burnet County Jail on Nov. 8 and released the same day after posting a $25,000 surety bond.

Thieves take $20,000 worth of items from Oakalla Volunteer Fire Department

OAKALLA — Authorities are searching for clues to catch burglars accused of taking several thousands of dollars worth of items, including $10,000 jaws-of-life equipment, from the Oakalla Volunteer Fire Department on a remote stretch of FM 963.

According to the Burnet County Sheriff’s Office, a nearby resident noticed an unsecured door Nov. 10 at the station in the 29,000 block of FM 963.

A subsequent investigation resulted in laundry list of stolen items from the building, BCSO Capt. Dwight Hardin said.

“It looks like they forced entry into the building, and there was quite a number of items taken,” he said. “The most expensive item was the cutting tool, primarily used to cut car-accident victims out of vehicles to try to save their life.”

Other items reported missing were a self-contained breathing apparatus ($4,000); hydraulic hoses ($1,000); hazardous materials ventilation apparatus ($2,200); a chain saw ($400); and miscellaneous medical gear, the reported stated. A tally of all the items taken is estimated to be more than $20,000, Hardin said.

The investigation is continuing.

Thieves steal $750 worth of electronics from Hoover’s Valley fire station

HOOVER’S VALLEY — Thieves took a flat-screen TV and a laptop computer from a volunteer fire agency in Sherwood Shores III, less than two weeks after another fire department reported thousands of dollar in fire and EMS gear stolen from their station, according to the Burnet County Sheriff’s Office.

The most recent incident was reported about 11 p.m. Nov. 20 after volunteers arrived at the Hoover’s Valley Volunteer Fire Department in the 300 block of CR 118B.

“Some of the volunteers were at the fire station and noticed the doors were unlocked,” sheriff’s office Capt. Dwight Hardin said. “They looked a little bit closer and discovered the TVs and laptops were gone.”

The TV was valued at $500, and the laptops were estimated at $250 each, according to the report.

“The investigators did fingerprint the location, and we’re going to wait for the outcome,” he said.

On Nov. 10, the sheriff’s office reported that burglars stole several thousands of dollars worth of items, including a $10,000 jaws-of-life, from the Oakalla Volunteer Fire Department on a remote stretch of FM 963.

“There’s quite a bit distance between the two locations,” Hardin said. The two agencies are about 50 miles apart. “I don’t know (that) you can say these are linked because they’re two very different types of things taken.”

SPICEWOOD — A 51-year-old man on parole who allegedly bragged that he would never go back to prison ended up right back in that direction Nov. 19 thanks to two Burnet County constables.

Burnet County Precinct 4 Constable Chris Jett assisted by Burnet County Precinct 3 Constable Jimmy Ballard in the arrest of Rickey Dale Nicholson about 1:30 p.m. at a construction site in Spicewood.

Jett said Nicholson, who has a Kingsland address, was wanted after his parole was revoked.

“I got an anonymous tip at my office that he was working at a construction site in Spicewood and had told other workers that he wasn’t ever going back to prison,” Jett said. When Jett looked up the warrant, he discovered parole officials had revoked Nicholson’s parole after a conviction of felony assault with strangulation.

“He was basically charged with family violence,” Jett said.

After learning Nicholson’s possible whereabouts, Jett asked Ballard if he would assist in serving the warrant.

“In a situation like this, where you have a person who’s said he’s never going back to prison, you want to have someone back you up,” Jett said.

As the two constables arrived at the construction site, they found Nicholson working on the roof. Jett said, when the man saw Ballard and himself, the parolee knew why they were there and offered no resistance.

Jett transported Nicholson to the Burnet County Jail, where he was being held as of Nov. 22.

“He had a pretty extensive criminal history,” Jett said about Nicholson. “He had probably 14 arrests and several felonies. It’s good to get him off the streets.”

BURNET — After a six-month investigation spanning from Mexico to two Bertram-area residences, law enforcement officials announced Dec. 4 the arrest of 15 people allegedly involved in the trafficking, storing and distribution of methamphetamines.

“It’s a big step in bringing down this organization,” said Burnet County District Attorney Sonny McAfee.

Police are still looking to arrest nine more individuals in relation to the investigation. All 15 are charged with the first-degree felony of engaging in organized criminal activity, but more charges could be coming as the investigation continues.

The arrests came after state, local and federal law enforcement officers raided two Betram-area residences. One of the properties was the residence of Jimmy Don Hardin, 42, while the other was that of Glen Alexander, 70. Officials said Hardin and his associates were distributing and selling 4-5 pounds of meth each month during the past six months. Officers put the street value of that amount at $200,000.

“This was a significant operation,” Burnet County Sheriff W.T. Smith said.

This is just one of the more than 70 firearms seized during a search of two Bertram-area properties that law enforcement officials believe served as the main hub of a major methamphetamine distributing and storage operation. Investigators seized 70 firearms, $10,000 in cash, more than 8,000 rounds of ammunition and two ounces of meth from the residences. The firearms included handguns, shotguns, assorted rifles such as semi-automatic weapons and at least one silencer.

They also found several pieces of body armor during the investigation.

State law enforcement officials said several of the firearms had been stolen. Along with the guns, drugs and cash, officers recovered many other pieces of stolen property that were allegedly used to barter for meth.

Major Jose Morales of the Texas Department of Public Safety’s Criminal Investigation Division said all the methamphetamines distributed by this organization came from Mexico.

That trend appears to be growing.

“In the years past, Mexican organized crime has begun to monopolize the meth,” said Greg Thrash of the U.S. Drug Enforcement Administration.

Officials said the methamphetamines allegedly being distributed from the Burnet County organization traveled from Mexico through San Antonio, Austin and Cedar Park before ending up at the Bertram-area residences.

Criminal investigators said Hardin and his associates allegedly distributed methamphetamines in Williamson, Burnet, Llano, Travis, Bell, Blanco, Lampasas and Bastrop counties. Investigators identified about 70 people who allegedly used or sold meth that they directly purchased from Hardin and his associates.

McAfee said the bust would have a significant impact on meth distribution in Burnet County and the surrounding area.

But the raid was not indicative of a problem only plaguing Burnet County.

McAfee said other prosecutors and law enforcement officials from across Texas and the nation have told him their communities are struggling with the rampant use of methamphetamines. He praised the law enforcement agencies and officers who helped make these arrests happen.

“We all talk about making our community a safer place to live, to work,” he said. “This is where it all happens.”

The investigation was a cooperative effort among 13 different state, local and federal agencies. Thrash said it was that kind of effort that allowed investigators to piece together all the information that led to the arrests and seizure of the guns and cash.

“We don’t have a problem connecting the dots in the greater-Austin area,” he said.

BURNET — With the holidays in full swing, people are out shopping and visiting friends, but they aren’t alone. There’s another group of people out and about hoping drivers will do the one thing that makes their “job” so much easier: leave their car doors unlocked.

“It’s probably the biggest factor in car thefts and people taking things out of cars,” said Capt. Joey Canady, commander of the Heart of Texas Auto Theft Task Force. He said if people took that one simple step as well as hiding valuables or gifts, it could substantially cut down on the number of vehicle thefts and burglaries.

Law enforcement officials said there are some things people can do to help prevent thefts.

Burnet County Sheriff’s Office investigator Stephen Savoy added that many car thefts and burglaries are crimes of opportunities. If a would-be thief finds a open car door, it’s an easy mark, the investigator said.

“Locking your doors and taking your keys are two of the best ways to stop this,” he said.

According to officials, a vehicle is stolen every eight minutes in Texas while another one is burglarized every two minutes.

Canady added that the Christmas holidays usually bring an increase in both activities.

During the holiday rush, a person walking through a department store or a shopping center parking lot trying to get into a vehicle won’t draw much attention, Canady said. So it’s up to the vehicle owner to help prevent thefts.

Canady recounted a TV commercial produced to cut down on car thefts that showed a man walking through a parking lot trying out car doors. As the would-be thief tried door handles, he was repeating, “She loves me, she loves me not,” when a door was locked. The moment he came upon a door that wasn’t locked, the man smiled and said, “She loves me.”

Cars and vehicles provide a source of fast cash for would-be thieves, Savoy said.

Canady agreed.

“They grab something, turn it into quick cash or even give it as present,” he said. “Sometimes, they’ll steal a new car or fairly new car and sell it for $300 or $400 just so they can get the cash.”

The “key” both men said was not to leave keys in the car, lock the doors and hide any valuables.

Meadowlakes experiences rash of vehicle burglaries

MEADOWLAKES — According to state statistics, a vehicle is burglarized every two minutes in Texas. And alleged thieves in Meadowlakes managed to bolster that statistic when they targeted at least 16 vehicles Dec. 19.

Burglaries made off with cash, credit cards and even a firearm.

Investigator Stephen Savoy of the Heart of Texas Auto Theft Task Force said Burnet County deputies responded to Meadowlakes after several people reported vehicle break-ins. And each of the cars had one thing in common.

“All of the cars were all unlocked,” Savoy said.

The investigator said it looked as if a burglar or burglars took items from eight vehicles.

“And there was at least eight other cars that showed signs of being entered, but nothing was apparently taken,” Savoy said.

Savoy and Meadowlakes officials are urging residents to remove valuables from their vehicles when leaving them unaccompanied and locking the doors.

But Savoy said that advice isn’t just for Meadowlakes residents, but for everybody.

“Locking you car door doesn’t mean they won’t break the window or pop the lock, but it definitely makes it more difficult,” Savoy said. “Most burglaries like these are crimes of opportunity. They walk along trying car doors, if it’s unlocked they get in.”

Along with locking vehicles at a residence, Savoy added it’s equally important to do it while out shopping or running errands.

“It only takes a few seconds for somebody to try a (car) door and get in and out,” he said.

Johnson City man gets seven 25-year sentences for abuse of mentally challenged woman

JOHNSON CITY — A Blanco County jury handed down seven 25-year sentences to a 77-year-old man convicted of abusing a mentally challenged woman who had lived with him for almost her entire life, according to the 33rd Judicial District Attorney’s Office.

The same jury convicted Eugene Barrett of Johnson City on continuous sexual assault of a young child and six counts of aggravated sexual assault of a disabled individual. According to the district attorney’s office, the charges stemmed from offenses committed between 2007 and 2010 involving numerous acts of sexual abuse.

Assistant District Attorney Stacy Burke and District Attorney Sonny McAfee presented evidence during the trial in the Blanco County Courthouse that showed the mentally challenged female victim, now 18, had lived with Barrett most of her life. The district attorney’s office also presented evidence that the sexual abuse began sometime in the early 2000s.

District Judge Allan Garrett presided over the trial.

Under state law, Barrett must serve 50 years of his sentence before he is eligible for parole.

Burke said Barrett was a true predator, who chose to prey on someone who was unable to defend herself.

She also commended the jury for handling the difficult task of hearing the evidence in the case.

McAfee added his own praise for the jury, noting the members carefully followed the evidence and determined the offense was continuous sexual abuse as well as finding the additional offenses of sexual abuse of a disabled person also had occurred.

This is the first time a case of continuing sexual abuse of a child had been tried in the 33rd/424th Judicial District, according to McAfee.

The offense became a law in 2007 and was designed to prosecute repeat offenders, whether the same victim is sexually assaulted or a different victim is involved in a continuing scheme of abuse, according to the district attorney.
