Amber Mist Engebretson, 20, of Buchanan Dam was arrested April 11 by the Department of Public Safety (DPS) for possession of marijuana. She was released the same day after posting a $1,000 bond.

Santos Sam Flores, 44, of Horseshoe Bay was arrested April 11 by the Burnet County Sheriff’s Office (BCSO) for a weekend commitment-driving while intoxicated. He was released April 13 after a commitment.

Burnet County jury finds man guilty in 2012 murder-for-hire

BURNET — A Burnet County jury deliberated for about an hour April 29 before finding a 61-year old man guilty of hiring two other people to kill 85-year-old Bonnie Harkey of San Saba County and her caretaker in March 2012.

After the jury’s verdict, State District Judge Allen Garrett sentenced Bruce Wayne Harkey, who is the stepson of the elder Harkey, to life in prison without parole for the capital murder (while renumeration) of the 85-year-old woman and her caretaker, Karen Johnson.

Two other people, Carl Wayne Pressley, 30, and Lillian Annette King, 27, already pleaded guilty for their roles in the murders. Pressley accepted a life sentence without parole after pleading guilty to actually carrying out the crimes while King accepted a 45-year sentence for her involvement.

They will be sentenced in May.

District Attorney Sonny McAfee, who tried the case, said Bruce Harkey was the architect behind the plot to murder Bonnie Harkey and Johnson — all for money.

Bruce Harkey agreed to pay Pressley $250 to kill Bonnie Harkey with a $100 downpayment changing hands. But it wasn’t this amount that was the reason for the murders.

“The underlying money they were to get was really the motivation for the murder,” McAfee said.

Bonnie Harkey held substantial property in San Saba County, most of it as the Harkey Pecan Orchard. A review of the San Saba County Appraisal District records shows the Bonnie Harkey estate (real and business property) is valued at more than $880,000.

Pressley is the adopted son of Bonnie Harkey’s daughter, and, upon Bonnie Harkey’s death, he was in line to inherit part of the estate. Bruce Harkey, however, had purchased Pressley’s rights to that land, which meant it would fall into his lap, McAfee said.

“It was quite a lot of money that would pass to Bruce Harkey upon Bonnie Harkey’s death,” the district attorney said.

In March 2012, Pressley and King went to Bonnie Harkey’s home on U.S. 190 in San Saba County, where Pressley first killed Johnson by suffocation. Johnson’s 10-year-old son discovered the woman’s body.

McAfee said the two then kidnapped Bonnie Harkey and drove her to Leon County about 200 miles away.

According to McAfee, Bonnie Harkey was struck on the back of the head with a blunt object and “then held underwater and drowned.”

Authorities recovered Bonnie Harkey’s body from a shallow grave in the bottom of a creek near a recreational vehicle park where Pressley apparently had a trailer. It was Pressley who led police to the woman’s body a few days after her death.

The trial was moved to Burnet County after Harkey’s attorney requested the change of venue because Harkey didn’t believe he could get an impartial jury in San Saba County. Both Bruce Harkey and Bonnie Harkey are well known in San Saba County.

McAfee said his office agreed to the change of venue if the trial would be moved to Burnet County.

The trial began April 21 in Garrett’s courtroom.

McAfee pointed out this wasn’t the first time Bruce Harkey had planned the demise of another person. McAfee said Harkey served five years in federal prison after being caught in possession of a silencer for a firearm. But during the course of the investigation into the silencer, McAfee said law enforcement learned Bruce Harkey had allegedly tried to hire somebody to kill his then-wife.

McAfee described Bonnie Harkey as a wonderful woman who was well loved in San Saba County.

“For somebody to come up with a plan just over greed and money is just incomprehensible to me. And then to carry out that plan by killing Bonnie Harkey as well as Karen Johnson is, again, it’s just incomprehensible how somebody could come up with the kind of motive or conduct,” McAfee added.

Longtime burglar receives long-term prison sentence for Bluffton crime

LLANO —  A Llano County jury convicted Jimmy Dale Lackey of burglary of a habitation, and State District Judge Allen Garrett followed it up by sentencing the man to 50 years in prison.

The jury convicted Lackey on May 6 after a trial that started the day before. Assistant Llano County District Attorney Richard Crowther presented evidence the man burglarized a home in the Bluffton community Sept. 19, 2012. During the burglary, Lackey made off with a valuable coin collection and some arrowheads. He also stole a pistol and ransacked the home.

Lackey is no stranger to the legal system. According to the district attorney’s office, Lackey’s criminal history includes eight previous felony convictions, including six prior burglary convictions, over the span of 21 years.

“(The verdict) sends a strong message to other felons that burglaries in rural Llano County will not be tolerated,” Crowther said. “Protection of people’s property is a major goal of our prosecuters.”

Llano County District Attorney Sonny McAfee praised the verdict and the sentence.

“This is another important milestone in law enforcement’s collective effort to protect the property of every person in our district,” he said. “Thanks to the hard work of the Llano County Sheriff’s Office, the jury was able to hold this defendant accountable for his actions.”

Co-conspirators are sentenced in San Saba County double-murder

SAN SABA — Less than a month after a Burnet County jury found the mastermind behind a double-murder guilty, State District Judge Allan Garrett sentenced two more co-conspirators in the San Saba County case to long prison terms.

On May 15, Garrett levied a life sentence with no possibility of parole against Carl Pressley, 30, for murdering Karen Johnson at a residence on U.S. 190 in San Saba County on March 25, 2012, before kidnapping the homeowner, Bonnie Harkey, 85, and taking her to Leon County and killing her as well.

Lillian Annette King, 27, who assisted Pressley in transporting Harkey to Leon County, was sentenced to 45 years in prison, though she could be eligible for parole in 22½ years.

At the heart of the case was one man’s greed.

On April 29, a Burnet County jury found Bruce Wayne Harkey, 61, guilty of capital murder (with renumeration) for his role in the death of the elder Harkey and Johnson. Under Texas law, once the jury found the man guilty of the capital murder offenses, Garrett had to sentence him to life in prison without the possibility of parole.

Though Bruce Wayne Harkey wasn’t present at the deaths of either victims, District Attorney Sonny McAfee presented evidence showing the man hired Pressley to kill Bonnie Harkey.

Bruce Wayne Harkey was Bonnie Harkey’s stepson. Pressley was the woman’s adopted grandson.

Bonnie Harkey held substantial property in San Saba County, most of it as the Harkey Pecan Orchard. Upon her death, Pressley was in line to inherit part of the estate.

During the 61-year-old’s trial, prosecutors showed Bruce Wayne Harkey had bought Pressley’s rights to the land, which meant it would fall into his lap.

Bruce Wayne Harkey paid Pressley a $100 down payment of a $250 total to kill the elderly woman.

According to the district attorney, Pressley enlisted KIng’s assistance to kidnap Bonnie Harkey on March 25, 2012, when she and her caregiver, Johnson, returned from church. The initial plan was for King to distract Johnson so Pressley could subdue the elderly woman, but things changed when the caregiver saw Pressley.

Pressley then suffocated Johnson and left her body at the residence, where her young son found her.

The two, Pressley and King, then drove Bonnie Harkey to Leon County in East Texas, where Pressley struck her on the head and drowned her in a creek.

When the returned to San Saba County, law enforcement officers arrested them.

Both Pressley and King confessed to the crimes, according to the district attorney’s office.

In separate interviews, King and Pressley named Bruce Wayne Harkey as the one who offered to pay for Bonnie Harkey’s murder, according to the district attorney’s office.

The district attorney’s office waived the death penalty in Pressley’s case in exchange for his guilty plea and his testimony against Bruce Wayne Harkey. King, who also testified against Bruce Wayne Harkey, pleaded guilty to her role in the murders for a 45-year prison term.

McAfee expressed his gratitude to all the people who helped during the investigation that led to the arrests and convictions of the three “dangerous felons” who plotted and carried out the murder of Bonnie Harkey.

Ex-Cottonwood Shores mayor indicted in alleged library theft in 2013

COTTONWOOD SHORES — A Burnet County grand jury indicted a former Cottonwood Shores mayor and another woman earlier in May for allegedly making off with between $5,000 and $10,000 in equipment and supplies from the Cottonwood Shores Library in May 2013.

Former Cottonwood Shores mayor Janelle Long, 66, and Rebecca Sullivan, 58, face state jail felony theft charges for allegedly taking numerous items, including computers, office supplies, furniture and a laundry list of things from the library. They are the second and third people charged in the act.

In April, the grand jury indicted former Cottonwood Shores administrator Janet Kay Taylor-Carusi, 56, in the alleged theft as well.

Cottonwood Shores Police Chief Harold Piatt said he believes the three acted out of “retaliation” to the community after voters selected Donald Orr over Long in the May 2013 mayoral election. Long had been the mayor since 2011 after the council appointed her to that position. Soon after the election, Piatt said the three entered the library and basically intimidated the two elderly librarians in order to take numerous items.

“And they took so much of the equipment, they functionally closed the (library),” the chief said. “They virtually took everything that wasn’t nailed down except for the shelves and the books.”

All three face theft of property charges between $1,500 and $20,000.

After the alleged theft, officials had to close the library for about a month and a half until they could replace much of the equipment and supplies. The replacements came from city funds and donations, the chief said.

Piatt said the suspects claimed they were simply recouping items donated through a local charity to the library. According to the chief, the suspects claimed under the charity’s by-laws that if the library closed, the group could reclaim the donated items.

“But the library did not close,” he pointed out. “They closed it when they took the property.”

Plus, he added, that after a individual, group or entity donates something to an organization, it belongs to that organization and the giver has no right to take it back.

Though the city has replaced many of the allegedly stolen items, Piatt said he will continue to work to recover the missing items.

Taylor-Carusi was arrested April 22 and booked into the Burnet County Jail. She bonded out later the same day.

Piatt said Long and Sullivan turned themselves in May 16. Both bonded out later the same day.

If convicted, the suspects could face up to two years in state jail and up to a $10,000 fine.

On May 10, Long lost her bid for the Cottonwood City Place 3 council seat.

Green Dot card scam targeting elderly promises a new car

MARBLE FALLS — At first, it sounded like an exciting day for one Walgreens customer as she shared with the checkout person her good fortune. She told the employee how she had won a new car and only had to pay a $500 fee for tax, title and license to get it.

The elderly customer was in the process of buying a Green Dot card, which would allow her to pay the fee over the phone to the company awarding the prize.

But something just didn’t sound right to the Walgreen’s staff.

“As we started asking more questions, we really became concerned,” said Melissa Crumley, the Marble Falls store manager. “Then, we realized this was a scam.”

Crumley and her staff told the customer what was really going to happen when she gave the Green Dot number to the person who contacted her about her new car.

The money would be gone, and she wouldn’t get any car.

Marble Falls Police Capt. Glenn Hanson shared some words of caution.

“It may sound trite, but if it sounds too good to be true, it usually is,” he said. “You should never give personal information, banking information or anything like that over the phone or through email to any unsolicited call or email.”

The woman, a bit disappointed about not winning a car, opted not to purchase the $500 on the Green Dot card. At first, Crumley thought it might be an isolated case, but she and her staff soon found more elderly customers coming in looking for the Green Dot cards and trying to purchase $500 on them.

“We had two come in just today,” Crumley said May 22. “It’s just not right. These people are targeting senior citizens.”

Crumley said the current scam starts when a person allegedly from the Publishers Clearing House Sweepstakes calls the victim at home and informs him or her that he or she has won a new car. But the “winner” has to pay for the tax, title and license.

In order to pay it, the caller directs the person to go to Walmart, Walgreens or another store to get a Green Dot card, which is basically a prepaid debit card. Crumley said customers put funds on it through a MoneyPack or similar recharge method.

Crumley said she wasn’t sure who the victim would then contact, but the scammer would ask for the Green Dot card or recharge code.

“Once you give that number to them, they can get the money,” Crumley said. “And there’s really no way to trace it or get it back.”

And, there’s no car.

“We’ve got to the point here (at Walgreens) that we’ll question any customer, especially elderly ones, who come in looking for a Green Dot card,” she said. “We can’t stand by and let people fall victim to this scam.”

Some customers, even after hearing the Walgreens employees explain the likely scam, decided to try anyway.

While the Walgreens staff can monitor their customers, Crumley pointed out there are lots of other place to buy the Green Dot cards and reload them.

This isn’t the only scam making its rounds. Recently, a woman reported she received a phone call from her “credit card company” advising her that her card had been frozen. All she had to do was provide the caller with her number, and it would be unfrozen.

The woman, however, didn’t provide any information because she realized it was a scam to get her credit card information.

Hanson said the scams aren’t limited to phone calls.

“You get a lot of them through email as well,” he said.

Some of the scams promise high-paying jobs, which you can do at home. Hanson described one in which an email promises a job, but the new “employee” must commit to purchasing a Green Dot card with, say, $1,000 on it. The guise, Hanson said, is the company sends a check for $1,250 with the additional $250 going to the “employee.” But when the person gets the Green Dot card, he or she provides the number to the “employer,” who then takes the $1,000 off it.

As for the check?

“It turns out to be counterfeit, so you’re left stuck with the loss,” Hanson said.

He added not to give personal or financial information to unsolicited phone calls or emails. If a person calls claiming to be from your credit card company or bank and needs your financial information, credit card number or routing number, Hanson said you need to be wary.

“If they are your bank or credit card company, they already have the information,” he said. “If you do get a call like that, you should hang up and call your bank or credit card company yourself and verify the call and caller.”

Then, there’s another one in which somebody calls a victim and claims to be a grandchild, nephew or niece and in some type of trouble. Typically, the caller claims to have been arrested in a foreign country and needs the victim to send them money via Western Union or similar company. The person will even direct the victim to a specific location to which to wire the money.

The money, once wired, is gone, and the relative, well, he or she was likely never in any trouble. The caller even uses a relative’s name and “begs” the victim not to contact “his or her parents” for any number of reasons.

One of the latest schemes involved a “grandson” calling his grandfather in the Highland Lakes and claiming he was a witness to a crime in Mexico. But in order to get released from police custody, the grandfather needed to wire a specific amount of money to a location in Mexico.

The grandfather took down the information, but, before wiring any money, he contacted the parents of the real grandchild who informed him the named individual was not anywhere near Mexico.

When the scammer called the grandfather back and demanded to know where the money was, the man simply hung up.

According to the FBI, telemarketing fraud is a national problem and one that often targets senior citizens. Some things the FBI website warns against is dealing with any “telemarketer” who uses phrases such as:

• “You must act ‘now’ or the offer won’t be good.”

• “You’ve won a ‘free’ gift, vacation or prize. But you have pay for ‘postage and handling’ or other charges (such as tax, title and license).”

• “You must send money, give a credit card or bank account number, or have a check picked up by courier.”

Hanson added many of these scams originate outside the United States, which means local law enforcement has little recourse.

The best thing, the captain said, is to protect yourself and your personal information.

Police: Quick response saves Horseshoe Bay stabbing victim’s life; man arrested

HORSESHOE BAY — Two German women visiting friends in Horseshoe Bay were the victims of a attack that sent both to the hospital June 10, but officials believe the quick response of medical and police personnel might have been the difference for at least one of the women.

At 12:22 p.m. on June 10, Horseshoe Bay police responded to a residence in the 100 block of Harbor Light in regard to an assault. The first officers arrived about two minutes after the initial call.

At the residence, they found two women, Gabriele Legeland, 41, and Heike Schlieker, 48, both of Germany, suffering from what appeared to be knife wounds. Marble Falls Area EMS and Horseshoe Bay Fire Rescue crews arrived on the scene and began treating the two women.

Horseshoe Bay Police Chief Bill Lane said he observed the initial treatment of both women and credited the survival of at least one of the victims to the “quick and decisive treatment” she received soon after that alleged attack.

Both women were transported to the University Medical Center Brackenridge in Austin.

Lane stated in a news release that, as of June 11, Schlieker was listed in critical condition, while Legeland was no longer listed as critical but remained hospitalized with less serious injuries.

Horseshoe Bay police charged Bastrop resident Johnathan Kirk, 34, with two counts of aggravated assault causing serious bodily injury, a second-degree felony.

The two women were visiting friends at the Harbor Light residence when Kirk allegedly entered the home with the intent to burglarize it, police said. The man was doing construction work at the home prior to allegedly breaking in.

Horseshoe Bay authorities said they believe the suspect didn’t know the two women were in the home when he entered but attacked them with a knife or other sharp object when the two saw him.

The suspect then fled the residence and area, but a concerted effort by local and state law enforcement officials helped locate the man in about three hours at his Bastrop home.

Lane said investigators used the technique of “pinging” the suspect’s phone to determine his location. Once police determined where he was, Horseshoe Bay officers contacted Bastrop police and the Bastrop County Sheriff’s Office, which immediately sent units to the suspect’s residence and detained him until Horseshoe Bay police along with Llano County District Attorney Sonny McAfee could obtain a search warrant for the man’s home and vehicle.

During a search, authorities recovered bloody clothing and a knife they believe might have been used in the alleged attack.

Lane commended the efforts of all the responding and assisting agencies.

“The level of cooperation was immediate and unprecedented,” he said.

Lane pointed out deputies from both Llano and Burnet counties helped with the search, while Marble Falls police personnel not only handled a tremendous amount of emergency radio traffic but initiated the pinging of the suspect’s cell phone, leading to his detainment by Bastrop police.

During all of this, Texas Rangers in three different cities helped with the investigation that led to Kirk’s arrest.

“My own staff of officers, investigators and dispatcher are also to be commended for their calm and efficiency in the face of a tremendous hectic and critical event,” the chief said.

Horseshoe Bay police are continuing to investigate the attack.

Marble Falls ISD tightens security in wake of child porn case

MARBLE FALLS — Marble Falls Independent School District officials have tightened security policies and launched facility monitoring procedures in the wake of a child pornography investigation involving a former technology department employee accused of collecting images of students in private areas at two campuses.

The alleged incidents were said to have taken place at Marble Falls High School and Marble Falls Middle School, according to school officials.

MFISD administrators fired 31-year-old Deavon DeLancey of Cottonwood Shores on June 5, the day Texas Rangers arrested and charged him with aggravated sexual assault of a child and possession of child pornography.

DeLancey remains in the Burnet County Jail with two bonds totaling $1.1 million.

“We found out (June 5) and took immediate action, dismissing him as an employee and going through campus by campus with law enforcement to ensure that our facilities were safe,” MFISD Superintendent Rob O’Connor said.  “We know what to look for because the employee had confessed to having placed certain devices in certain areas, primarily on the secondary, middle school and high school campuses.

“Moving forward, we will have a heightened awareness about private areas and making sure we monitor those areas very closely,” he added. “Unfortunately, we know what to look for so those area will be spot-checked on an ongoing basis.”

Authorities found no devices on campus; however, they are sifting through images from DeLancey’s school computer as well as his personal computer and devices as the investigation continues, officials said.

The investigation into DeLancey started several months ago when Cottonwood Shores police received a report of inappropriate images on a private computer.

The local agency referred the case to the Texas Rangers, who found video of what the probable cause affidavit described as Delancey molesting a 4-year-old girl — the origin of the aggravated sexual assault of a child charge.

“The aggravated sexual assault did not occur on any of our campuses. It was a charge that was brought about by his behavior off district property,” O’Connor said.

Another component of the investigation involves the allegation of images collected at school facilities, according to a statement from the school district.

O’Connor said no district technology equipment was used to gather images.

“He did work in the technology department, but that was the extent of district technology being involved in this issue. … The employee in question was using his own personal devices to engage in his own inappropriate behavior. It had nothing to do with district technology,” he said. “Because it was the actions of one employee, the other employees in the district are obviously concerned, and their awareness has been heightened.”

Officials added they had no reason to believe DeLancey had posed a threat to students.

DeLancey worked for the district for more than a decade. His background included serving as the chief of the Cottonwood Shores Volunteer Fire Department until his resignation in January. He also is a former Cottonwood Shores city councilman, who was appointed to fill an unexpired term and then withdrew from a follow-up election.

Up until the arrest, he also served as a firefighter for the Marble Falls Area Volunteer Fire Department. Officials at the agency subsequently removed him from their roster.

“All employees of the district have to go through an extensive criminal background check to the extent they have to provide fingerprints. Those fingerprints get processed through a state level, national level. … Initially, it’s when they’re hired, then we do random checks on a variety of employees throughout the year,” O’Connor said. “Once they’re in that databank, we get notified if any of our employees ever get arrested.

“It does help us in that sense of tracking if any of our employees have any pending charges on them, whether it happened in our community or outside,” he added.

Jail records for DeLancey showed he was arrested in 2003, when he worked as an aide at MFISD, on a charge of injury to a child.

There were no public records found within the district clerk’s office, the county clerk’s office, family court or justice of the peace offices regarding a disposition or court proceedings related to the injury to a child charge.

School administrators will continue cooperating with law enforcement including potentially identifying students who might appear in images connected to the investigation, O’Connor said.

He added that school officials have met with principals and administrators to clarify and reinforce protocols for security and reporting issues.

“We’re not excluding any campus. We’re continuing to make sure all our campuses are safe,” O’Connor said. “It’s the last thing the employees want. They’re here to protect our kids, to safeguard our kids, so they do not want this negative light shed on the district.”

Three indicted in Burnet assault, kidnapping case; death ruled homicide

BURNET — A case that shocked residents earlier this year took another step forward in June as the Burnet County Grand Jury indicted three suspects for allegedly holding one woman against her will and sexually assaulting another.

Charlotte Elaine Arms, 45, faces a list of felony charges in relation to an investigation that began in January after police went to a residence in the 700 block of North Pierce in response to a report of a deceased person.

According to Burnet Police Chief Paul Nelson, the woman’s cause of death has been ruled a homicide. Officials said it is still under investigation.

Burnet police officers found 29-year-old Rebecca Schaller dead in the residence, but, during the course of the investigation, authorities believe Arms and others allegedly kept a second woman against her will for several months and subjected her to several physical assaults.

The grand jury indicted Arms on three counts of aggravated assault with a deadly weapon, two counts of sexual assault, one count of aggravated kidnapping and one count of assault of family/household member (with) impeding breath/circulation. She was first arrested in March and remains in the Burnet County Jail.

Along with her arrest, Burnet police charged Walker Shapland, 24, with kidnapping and assault in the case as well. On June 3, the grand jury also indicted the man on two counts of aggravated kidnapping and two counts of aggravated kidnapping as well.

The third man, Thomas Allen Simon, was indicted on sexual assault and aggravated assault with a deadly weapon.

The bizarre case came to light to authorities Jan. 28 when they responded to the residence, where they found Schaller’s body. As investigators followed up on the woman’s death, they noticed no real sense of loss or remorse from the eight adults and six children sharing the home, according to an arrest warrant affidavit issued in March for the suspects.

As investigators continued to look into Schaller’s death, they began to piece things together, both from what they were told and what was missing. According to the affidavit, officers noted several people provided written statements regarding Schaller’s death, but several people hadn’t, including Arms and the alleged kidnapping victim.

Investigators reached out to a Child Protective Service investigator to get information about this other woman and, if possible, get her out of the house so they could speak with her. On March 6, a confidential informant told investigators Schaller and the alleged kidnapping victim were Arms’ nieces by marriage and the informant had witnessed Arms abuse Schaller and the other woman and instructing others to abuse them as well, according to the affidavit.

On March 10, officers were able to get the alleged victim out of the house, and she then confirmed the confidential informant’s information. She also went on to describe several other alleged assaults, including a time between Oct. 31, 2013, and Nov. 5, 2013, when the two kidnapping suspects tied her to a bed and beat her with a wooden paddle and a leather belt, the affidavit stated.

According to the indictment against Arms, she assaulted the alleged victim in November 2013 with a wooden paddle.

The grand jury also indicted Arms for allegedly stabbing the deceased woman the day prior to police discovering the body. The two sexual assault indictments stem from Arms allegedly directing Simon to sexually assault Schaller, who was his wife, in September 2012.

Simon’s two sexual assault indictments also are from that alleged incident. He also faces an aggravated assault with a deadly weapon indictment.

All three remain in the Burnet County Jail. Shapland is being held in lieu of $600,000 in total bonds; Arms is being held in lieu of $980,000 in bonds; and, Simon in lieu of $300,000 in bonds.
