Burnet police take gun-waving woman at H-E-B into custody

BURNET — Police responded to a local grocery story after a caller reported a woman in the parking lot waving a gun.

Burnet officials said officers arrived at the H-E-B, 105 S. Broadway, at 4:53 p.m. Oct. 8 in response to a call about a women waving a gun around and putting it in her mouth. Officers secured the parking lot to reduce any danger to the public.

Some H-E-B patrons had to stay inside the store while officers worked to resolve the situation outside.

Burnet police took the woman into custody after about 20 minutes without incidence. Officers recovered two semi-automatic pistols, including one the woman had in her waistband.

Authorities transported her to a hospital for evaluation but did not charge with any crime. Police say the incident is still under investigation.

$2 million bond set for Burnet County man in murder case

BURNET — State District Judge Allan Garrett set a $2 million bond on Oct. 7 for Garrett James Ballard, 21, who faces a capital murder of multiple persons charge for allegedly gunning down two of his friends in August.

Burnet County investigators have charged Ballard for allegedly murdering Elijah Adam Benson, 17, and Travis Leslie Fox, 26, on Aug. 19 after the three supposedly used hallucinogenic drugs, according to an arrest warrant affidavit.

Deputies arrested Ballard on Aug. 19 and booked him into the Burnet County Jail, where he’s been since that date without a bond until Oct. 7.

District Attorney Wiley “Sonny” McAfee said the amount of bond was in response to the severity of the alleged crime.

“Safety of the community is always a major concern for the DA’s office as well as the courts for setting bond,” McAfee said. “The bond is to ensure that someone appears in court. It is also to ensure the safety of the community and the judge is to consider the circumstances of the offense.”

The district attorney said several witnesses testified before Garrett to the severity, nature and circumstances of the offense.

According to the arrest warrant affidavit, Ballard told investigators he and the two other individuals had purchased some “acid’ from another acquaintance and returned to his residence on the 5800 block of CR 340 to celebrate one of the men’s birthdays.

But sometime during the celebration, Ballard told investigators the two alleged victims began demonstrating “strange and disruptive behaviors.” At some point, Ballard obtained a rifle from a relative’s vehicle and shot the other two men, the affidavit stated.

“The judge heard evidence,” McAfee said regarding the bond hearing. “The evidence showed there was proof evident that a capital murder had occurred.”

Ballard has not been indicted for the alleged crimes at this point. McAfee said he and his office are still working on presenting the case to the grand jury.

“Talking about capital murder cases, in general, oftentimes they can be very complicated,” the district attorney said. “There are a lot of things that we need to nail down that investigators have to follow up on, and those things take a considerable amount of time.”

McAfee added that capital murder cases in general tend to require more time and energy because the only punishments available are life without parole or the death penalty.

Cedar Park police capture Burnet County escapee

CEDAR PARK — Police captured a Burnet County Jail inmate who assaulted a deputy and took his weapon before fleeing on foot Oct. 11.

A Burnet County deputy had transported Murl Lamb, 40, to the Cedar Park Regional Medical Center on Oct. 11. As medical staff was treating the inmate, police say Lamb attacked the deputy, took his weapon and escaped on foot about 6:30 a.m.

Lamb had been in the Burnet County Jail since Aug. 21 on a string of charges, including aggravated robbery, a parole violation, robbery, burglary of building, theft and criminal mischief. He was being held on more than $450,000 in bonds.

Cedar Park police secured a perimeter of the immediate area. Williamson County deputies, Leander police, the Lone Star Fugitive Task Force and Burnet County deputies assisted in the search for Murl.

Officials asked people to stay away from the area, including the 1890 Ranch shopping center on RR 1431 just east of the U.S. 183 tollway.

Officers apprehended Murl about 11 a.m. behind a theater in the shopping center.

Officials said additional criminal charges are pending against the suspect regarding the Oct. 11 incident.

Suspect in Kingsland truck theft caught in Galveston

GALVESTON — Authorities have caught the fourth fugitive in the past two weeks with the latest suspect accused of injuring a police officer with a vehicle, according to reports.

Authorities say they captured 36-year-old Rocky Drew McIntosh after a 12:20 a.m. warrant dispatch Oct. 11 in Galveston.

McIntosh had been at-large since Sept. 21, when police reported he stole a 2005 GMC pickup in broad daylight from a convenience store in Kingsland.

A manhunt followed that included the suspect slamming his vehicle into a Sunrise Beach police chief’s patrol unit and injuring the officer while she was outside her car.

“We confirmed a warrant on McIntosh from law enforcement in the Galveston,” Llano County Chief Deputy John Neff said.

McIntosh faces a first-degree felony charge of aggravated assault on a public servant.

“At least all three of the guys that ran in that past several weeks are accounted for and in custody,” Neff said.

In two other reports:

• Edward Levi Adamson, 47, was in custody in Kerr County as of Oct. 2. Adamson was wanted out of Llano after he allegedly broke into an elderly couple’s Llano home Sept. 26, assaulted the woman and tied up the man. He faces a string of charges, including first-degree felony injury to an elderly person.

• Justin Friar, 25, was captured in Mason County on Oct. 8 after a nine-hour manhunt that spanned Mason, McCullough and Llano counties including searches on private property. Investigators tracked the suspect to Pontotoc, where he was seen getting into a pickup truck that was eventually stopped. He was then taken into custody. Friar was wanted on drug and burglary charges, police reported.

Also, authorities captured another suspect wanted after a Burnet County in-custody escape incident at a Cedar Park hospital Oct. 11. Murl Shane Lamb, 40, overpowered a corrections officer in the parking lot of Cedar Park Regional Medical Center, took the officer’s gun and fled. After a four-hour manhunt, Lamb was eventually found in a dumpster behind a Cedar Park movie theater, according to the Burnet County Sheriff’s Office.

Jail records show Lamb faces additional charges of first-degree felony aggravated assault on a public servant, taking a weapon from a public servant, escape (causing serious bodily harm)/threat with a deadly weapon for the alleged escape attempt.

Lamb remains in the Williamson County Jail with bonds totalling $1.1 million.

Felon arrested for threatening Marble Falls teens with an ‘air-soft’ pistol

MARBLE FALLS — A man previously convicted of multiple felonies, including aggravated sexual assault of a child, faces new charges after he allegedly threatened a group of teenagers with a pistol.

The firearm, however, turned out to be an “air-soft” pistol, which fires a hard plastic projectile, officials said.

Marble Falls police charged David Andrew Crum, 38, with aggravated assault with a deadly weapon and unlawful possession of a firearm by a felon after witnesses reported the man pulled a handgun in the Marble Falls Walmart parking lot on Oct. 3 and pointed it at several teenagers.

One witness told the responding officer that he feared for his life, according to an arrest warrant affidavit.

Marble Falls officer Dorian Turner responded to the parking lot in the 2700 block of U.S. 281 on Oct. 3 at 9:47 p.m. after a caller reported a person brandishing a weapon. When Turner arrived between 20 and 30 teenagers swarmed around him. The teens reportedly witnessed the suspect pull the firearm and point it at them before turning his attention to an 18-year-old man in particular.

According to the affidavit, the incident started several minutes prior to the parking lot episode when the 18-year-old victim had stopped at the the traffic light at U.S. 281 and Mormon Mill Road. The teenager told Turner he saw one of his friends in another car turning onto the highway, so the alleged victim honked his horn and waved at the friend.

The teenager told Turner when he looked at the car next to him, the driver was staring at him. The teen raised his arms at the suspect “in a questioning” manner, which led to an exchange of words and the 38-year-old man allegedly spitting toward the teenager’s vehicle, according to the affidavit.

The suspect then followed the teenager to the Walmart parking lot, where the youth was going to hang out with a bunch of his friends. But when the teen arrived, the man who followed him in the second vehicle became belligerent.

At some point, the suspect got out of his pickup with a gun and pointed it “around at everyone,” the affidavit stated. Then, the man pointed the pistol directly at the 18-year-old, with whom he had exchanged words at the U.S. 281-Mormon Mill intersection.

“I felt pretty scared,” the teenager told Turner. “I really thought he was going to shoot me.”

The alleged victim described the handgun as a black semi-automatic, “possibly a Beretta make,” according to the affidavit.

Turner obtained a description of the suspect and the license plate number of the man’s pickup. He also took 20 witness accounts, which provided consistent statements regarding the incident.

The officer was able to link the pickup to Crum based on the license plate information. Turner also obtained the Walmart video surveillance of the parking lot, which also seemed to support the witnesses’ statements.

During his investigation, Turner learned Crum had previous felony convictions for burglary of a building, impersonating a public servant and two counts of aggravated sexual assault of a child from several different jurisdictions. Crum had just been released from his parole in August, according to the affidavit.

Marble Falls Police Sgt. Tom Dillard said that, during the follow-up investigation, officers learned the weapon was an air-soft pistol, which fires a hard plastic projectiles. Dillard said this type of weapon isn’t classified as a firearm under the penal code.

As for what this revelation means regarding the possession of a firearm by a felon charge, Dillard said that’s yet to be determined, but he believed the police still had enough to continue to pursue the aggravated assault with a deadly weapon charge.

Crum was arrested Oct. 10 after a traffic stop and booked into the Burnet County Jail on the latest charges. But according to jail records, he was released later the same day after posting bond.

Burnet man charged with intoxication manslaughter in Marble Falls crash

MARBLE FALLS — Police charged a 26-year-old Burnet man with intoxication manslaughter for the death of a Granite Shoals woman after tests determined the suspect’s blood-alcohol content was three times over the legal limit.

Matthew Lewallen was booked into the Burnet County Jail on Oct. 15 for intoxication manslaughter with a vehicle. The charge stems from a deadly accident Sept. 21 in the 1400 block of U.S. 281 about 2:20 a.m. in Marble Falls.

Marble Falls Police Sgt. Barry Greer said Lewallen was driving a 2003 Chevy Silverado pickup heading north on the highway when it crossed into oncoming traffic and collided with a Ford Explorer driven by Sandra Hart, 47, of Granite Shoals.

According to an arrest warrant affidavit, Hart died at the scene.

Emergency crews transported Lewallen to Seton Highland Lakes Hospital in Burnet for evaluation after the accident, but, at the time, officers said they would have to wait until the blood-alcohol test results came back before they made any charges. But soon after the accident, Greer said officers believed alcohol was involved.

In the arrest warrant affidavit filed by Marble Falls Police officer Dorian Turner, Lewallen’s hospital records showed he had a blood-alcohol limit of three times the legal limit, which is .08 blood-alcohol content.

Turner, who was a responding officer to the accident, stated in the affidavit that after fire crews freed Lewallen from the vehicle, the man was conscious “but not aware of how the crashed happened or of his surroundings.”

“During my contact with him, I smelled a strong odor of an alcoholic beverage emitting from his breath, his speech was slurred, the whites of his eyes were really red (bloodshot), and he said he had consumed two beers,” the documented continued.

Dorian stated in the affidavit that his belief was the suspect’s intoxication level led to the collision that caused Hart’s death.

Hart was by herself, while Lewallen had a passenger in his pickup. The passenger, Matthew King, 23, of Kyle was arrested at the time of the accident and charged with public intoxication.

Marble Falls Municipal Judge Cheryl Pounds requested Lewallen’s bail set at $75,000 according to the affidavit.

Long investigation in Burnet County nets alleged major meth supplier

BURNET — Burnet County Sheriff’s Office investigators arrested a man Oct. 17 who they believe supplied the majority of methamphetamine to local users.

“For us, he’s a large, significant trafficker,” Capt. Dwight Hardin said. “He was responsible for supplying a majority of the people in Burnet County with methamphetamine.”

Deputies charged Bobby Earl McGraw, 41, with manufacture/delivery of a controlled substance (between 200 and 400 grams), a first-degree felony. He also faces six counts of possession of a firearm by a felon.

According to BCSO officials, the Texas Department of Corrections paroled McGraw in June 2011 for a conviction of manufacture/delivery of a controlled substance (over 400 grams).

During a search of a residence in the northwestern part of Burnet County off RR 2341, investigators seized more than eight ounces of methamphetamine with a street value of about $250,000 and more than $6,000 in cash. Hardin said they also recovered six stolen firearms and other alleged stolen items.

“We’ve been looking into McGraw’s activities for about a year now,” Hardin said. The captain added the sheriff’s office is still investigating the case and expects more arrests in the future.

Deputies booked McGraw into the Burnet County Jail on Oct. 17 on a bond totaling $190,000. He was released Oct. 19 after posting a surety bond.

The Burnet Police Department, the Heart of Texas Auto Theft Task Force, the Texas Department of Public Safety Highway Patrol and the Texas DPS Aircraft Section assisted with the search and arrest.

Manhunt in Marble Falls leads to capture of burglary suspects

MARBLE FALLS — Authorities captured two suspects Oct. 28 who were wanted in a string of burglaries and a vehicle theft after a nearly two-hour manhunt in the north end of the city, according to a police report.

Dylan Long, 39, of Graham and Jessica Grafton, 27, of Cleburne were arrested and face charges of evading arrest and unauthorized use of a motor vehicle, authorities said.

The incident started about 10:30 a.m. at the Stripes Convenience Store, 3409 U.S. 281, after a Burnet County Precinct 4 Constable Chris Jett responded to a call about possible suspicious persons and burglary suspects, officials said.

“They specifically said (the suspects) were inside asking customers if they would like to buy cigarettes out in the parking lot,” Marble Falls Police Capt. Glenn Hanson said. “When the officer arrived, these two subjects immediately began to flee on foot.”

Marble Falls Police arrived to assist and after a brief chase captured the woman. The man disappeared to the east of the convenience store in the brush, according to the report.

Sometime after noon, authorities received a call about a man attempting to break into a vehicle in a business parking lot on Resource Parkway in the Marble Falls Business and Technology Park, several hundred yards north, Hanson said. Police responded, found the suspect and took him into custody.

“The vehicle they were in was determined to have been stolen out of the city of Round Rock, Texas,” he said. “Inside the vehicle was evidence of burglaries that we believe were committed in Llano County.”

Police say Long was also wanted in Jack County on burglary warrants.

The investigation is continuing.

Granite Shoals city worker charged with sexual assault of 16-year-old girl

GRANITE SHOALS — An employee of the city’s streets and parks department faces a child sexual assault charge, after parents told investigators they found inappropriate messages on their teen daughter’s cell phone, according to the Granite Shoals Police Department.

Juan Carlos Morales, 35, of Marble Falls was arrested by Granite Shoals police Oct. 27 while he was at his job in the Granite Shoals Streets and Parks Department, according to the report.

“We received a report from the parents of a 16-year-old female who had discovered some evidence that she was in a relationship with Mr. Morales,” Capt. Gary Boshears said. “They discovered some conversations with Mr. Morales they felt were not appropriate. Upon further investigation, we determined it was a sexual relationship.”

Investigators say they believe the relationship happened during the first week in September at a Granite Shoals location and that the suspect was known to the family.

“The sexual relationship we believe happened one time,” Boshears said. “Regardless, with a 16-year-old, if they’re forced or not forced, 16 is not an age where you can give consent to have a sexual relationship.”

Morales remains in the Burnet County Jail with a $25,000 bond on a second-degree felony charge of sexual assault of a child, punishable by two to 20 years in prison if convicted.

A city official did not immediately return phone calls regarding the employment status of Morales with the city of Granite Shoals.

MARBLE FALLS — Two people face multiple drug charges after police responded to a medical call Sept. 29 to an apartment on Mustang Drive to not only find a man unresponsive and apparently suffering from a drug overdose but also a quantity of prescription drugs not prescribed to either person.

It’s a problem that Marble Falls Police Sgt. Tom Dillard said officers are seeing more and more — possession of multiple types of prescription drugs.

“We’re finding with folks illegally possessing prescription drugs, they’ll have three or four different types,” Dillard said. In past years, he pointed out, when they arrested somebody with marijuana or another illicit drug, it was usually just one type. But officers are now finding a cornucopia of illegally possessed prescription drugs in these cases.

Police arrested Bryant James Brand, 24, on Oct. 29 on four counts of manufacture/delivery of a controlled substance stemming from the September call, but officers added a possession of marijuana charge after they allegedly found him in possession of that drug when they arrested him.

On Oct. 30, police arrested and charged Savannah Teare, 19, on four counts of manufacture/delivery of a controlled substance, also in regard to the September call.

According to arrest warrant affidavits for Brand, Marble Falls police officers responded to a unit at the Vistas Apartments, 1700 Mustang Drive, about 4 a.m. regarding an unresponsive male subject who was “cold to the touch.” When they arrived, the apartment unit’s resident took officers to the man, later identified as Brand, sitting in a chair and unresponsive.

A third person, later identified as Teare, was allegedly “running around” and “hysterical,” according to the report.

Officers learned the man allegedly had taken methamphetamine and marijuana and possibly methadone.

While at the apartment, officers noted the presence of several suspected drugs, Dillard said.

Marble Falls Area EMS arrived, treated Brand and Teare and then transported them to a hospital.

According to the affidavit, officers located a quantity of pills, two syringes, a rubber strap commonly used to “tie off” prior to intravenous drug use, a digital scale and other paraphernalia.

Because of the presence of the scale, various types of drugs and baggies, officers suspected the two also might have been dealing, according to the affidavits.

The drugs found at the apartment included methadone, alprazolam, clonezepam and methamphetamine. Three of the charges are state jail felony level, but because of the amount of methadone allegedly found, it’s a first-degree felony charge punishable by up to 99 years or life in prison.

Both were booked into the Burnet County Jail. Teare has since bonded out, but as of Oct. 31, Brand was still in custody.

Body cameras on Granite Shoals police aid criminal investigations

GRANITE SHOALS — A rural agency has become the second in Burnet County to equip its officers with body cameras to add another tool to their crime-fighting arsenal, officials say.

Nine officers from the Granite Shoals Police Department started wearing the digital-remote cameras in mid-October.

The agency, which serves the community of about 5,000 people, is located five miles west of Marble Falls on Lake LBJ.

“You look at a lot of situations across the country where there’s questions about whether the officers were justified in using force,” Capt. Gary Boshears said. “In almost every situation where it’s controversial or there’s a question about (an investigation), there’s no video or it’s off video, and you have a long drawn-out process to determine justification. But if you have two minutes of video, it’s going to answer the question right there.”

Until now, Granite Shoals officers relied on officer audio equipment or vehicle-mounted digital cameras to help gather data for an investigation.

“In the past, if there was a question about what happened, we had to rely on statements,” Boshears said. “It’s going to help with accountability purposes. There’s going to be nothing that happens off camera.”

Officials said the cameras will chronicle protocols, decisions and actions as well as potential evidence.

“It covers the city. It protects the officer. It guarantees we’ll have far better prosecution,” Chief J.P. Wilson said. “This lets you see what we’re walking into when we walk into a house. It allows us for better prosecution for the courts to be able to see this, to have their eyes on exactly what we’re seeing.”

The Bertram Police Department, located 12 miles east of Burnet, was the first agency to utilize the cameras about a year ago.

“Technology has improved a lot, especially in the last few years. The cost finally started to come down. These cost less than $1,000 a unit versus $3,000 to $4,000 per unit,” Wilson said. “It can be repaired and serviced here in our office … I hope the rest of the departments get on board and start doing it.”

Such devices could help eliminate doubt in the courtroom, officials said.

“All of our officers love it because it eliminates the questions,” Boshears said. “For instance, if you walk up to to a car and you see something illegal, some contraband in the driver’s lap, it eliminates the question of, ‘Are you sure you actually saw that?’ It’s on the on-officer camera, so yes, we saw it.”
