Llano man pleads guilty in child sexual abuse case; avoids trial

LLANO — A 29-year-old man accepted 55 years in prison after pleading guilty to sexually abusing two young girls.

Richard Willis Blackburn entered the plea Aug. 1 in Llano County District Court.

Officials had anticipated taking Blackburn to trial Aug. 4 after previous plea negotiations couldn’t come to a resolution. But Blackburn pleaded guilty to two counts of aggravated sexual assault of a child, thus avoiding a trial.

During an earlier interview, Llano County Assistant District Attorney Stacy Burke said Blackburn sexually abused a 9-year-old and an 11-year-old girl at least twice for more than a month. The two victims knew Blackburn prior to the assaults taking place.

In April 2014, the Llano County Grand Jury indicted Blackburn on multiple counts of continuous sex abuse of a child (victim under 14).

According to Blackburn’s court-appointed attorney, Blackburn pleaded guilty to two counts of aggravated sexual assault of a child. The judge sentenced him to two 55-year prison terms, which will run concurrently.

During the investigation, Blackburn confessed to Llano police investigators. Though the defense motioned to get the confession suppressed, Burke said the district judge didn’t grant the motion, so the confession would have been admissible had the case proceeded to trial.

Burke added that the man is no relation to Llano County Sheriff Bill Blackburn.

Scammers use phone calls to mine ATM card, bank data

HORSESHOE BAY — Authorities are warning residents to avoid a scam targeting ATM cards or bank accounts in which thieves use automated cell phone calls in an attempt to steal private information.

“We’re starting to see an increase in the number of scams. We’ve already seen Internet scams, mail scams. We’ve had some new ones lately that seem to be coming in on cell phones,” Horseshoe Bay Police Chief Bill Lane said. “I had several members of the community contact me to tell me they got calls to say their ATM cards or bank accounts had been compromised.”

A successful scam artist relies on trust and a victim’s willingness to continue with a number of automated prompts.

“You’ll get a pre-recorded message that tells you either your bank card or your bank account has been cancelled or compromised, and they’ll ask you to dial ’1′ to get that resolved,” he said. “Once you dial that number, there will be a number of questions trying to determine your identity, so they can use that information against you to scam you.”

The call requests detailed information such as date of birth, Social Security number and bank account data.

“Banks or other entities don’t do business like this over the telephone,” Lane said. “Don’t ever trust the caller if that call comes to you.”

Residents should discontinue the fraudulent phone calls altogether.

“The way I would handle the phone call is hang up,” the chief said. “If you get (requests like this) on the Internet, notify your local law enforcement, so we can be alerted to this and put out advisories to the community.”

Investigators also warn residents to beware of other recent scams involving fake prize or lottery awards dependent on advanced payments.

“If it sounds too good to be true. It is,” Lane said. “Don’t fall for it.”

Man indicted on attempted murder charges in attack in Horseshoe Bay

LLANO — A Bastrop County man faces up to life in prison after a Llano County Grand Jury indicted him Aug. 5 on charges of attempted capital murder of multiple persons for allegedly attacking two women in Horseshoe Bay with a knife.

“This was a horrible crime,” Horseshoe Bay Police Chief Bill Lane said. “This was an effort to try and cut the throats of two defenseless women.”

On June 10, Horseshoe Bay police and emergency units responded to a residence in the 100 block of Harbor Light in regard to an alleged assault. Officers found two women, Gabriele Legeland, 41, and Heike Schlieker, 48, both of Germany, suffering from what appeared to be knife wounds. Both were transported to University Medical Center Brackenridge in Austin — one with life-threatening injuries and one with less serious injuries.

The two women were visiting a friend who lived at the home.

About three hours after the attack, police tracked down the suspected assailant, Johnathan Kirk, 34, in Bastrop County. He was a subcontractor working on the residence at the time of the attack, officials said.

Initially, police charged him with two counts of aggravated assault causing series bodily injury. But after the investigation, Llano County District Attorney Sonny McAfee asked the grand jury for an indictment on charges of attempted capital murder of multiple persons, a first-degree felony punishable by up to life in prison.

Lane said, while the initial charges were aggravated assault, the ensuing investigation caused officials to request the attempted capital murder charges.

“We were under the impression that the motive behind the stabbing was an interrupted burglary in progress,” the chief said. “As we continued on with our investigation, interviewed the victims and talked with a number of other sources in this matter, we soon became aware that this was an intentional assault.”

Investigators still haven’t been able to determine the suspect’s motive.

Kirk is being held in the Llano County Jail in lieu of more than a $1 million bond.

“This was one of the most heinous crimes, if not the most heinous, we’ve ever had in Horseshoe Bay,” Lane said. “This one just has a special classification beyond what we have seen in this area before.”

Police arrest teen after Burnet High School threat

BURNET — Burnet police arrested a 16-year-old on the Burnet High School campus after he called 911 and said he was going to kill people near the school.

Police did not release the juvenile’s name.

“We take everything as serious as possible,” Burnet Police Chief Paul Nelson said. “Our job is to prevent any harm to citizens or students in the city. I feel that’s what we did today.”

Officers were dispatched to the campus about 10 a.m. after the boy called 911, Nelson said.

“There was a threat made, but police immediately arrested the suspect,” said Keith McBurnett, Burnet Consolidated Independent School District superintendent. “At no time was the student who made the threat unsupervised. All activities are continuing as normal.”

The campus’ School Resource Officer first located the boy, who was unarmed, before additional officers arrived and the suspect was detained. Nelson said no weapons were found.

According to a news release from the department, the juvenile “made verbal statements to officers that he had a list of individuals, specifically band members, that were his intended targets. At the time of the threat, the Burnet High School band was holding practice about 100 yards away from the suspect.”

Nelson said the suspect was not in the band, the supposed targets just happened to be members of the band.

School begins Aug. 25 for the district, and Nelson said police will be visible around campuses and in the city.

“We always have an increased presence for the first few days,” Nelson said. “Nothing is different from last year or the year before last. Multiple officers will be out being seen at schools and on roads.”

Ex-Marble Falls ISD employee indicted in child sex assault

BURNET — A former Marble Falls Independent School District employee faces the toughest charge available under state law after allegedly sexually assaulting a 4-year-old child and videoing himself doing it.

On Aug. 5, a Burnet County Grand Jury indicted Deavon Ashley DeLancey, 31, of Cottonwood Shores on three counts of super aggravated sexual assault of a child, two counts of possession with intent to promote child pornography and one count of indecency with a child-sexual contact.

The indictment stems from a Texas Ranger investigation that actually began late last year after the Cottonwood Shores police received information that Delancey might have inappropriate images on his personal computer. The local agency referred the matter to the Texas Rangers.

Texas Ranger Gary Phillips arrested DeLancey on June 5 and initially charged him with aggravated sexual assault of a child.

Burnet County District Attorney Wiley “Sonny” McAfee said the higher-level of charges are because of the alleged victim’s age.

“(The Legislature) prescribed a minimum sentence of 25 years, and there is no parole for it if you commit aggravated sexual assault against a child younger than 6 years of age,” the district attorney said.

The Texas Legislature added super aggravated sexual assault in 2007 with a punishment range of 25 years to 99 years or life in prison with no chance of parole. An aggravated sexual assault of a child charge brings a possible term of five years to 99 years or life but with the possibility of parole.

McAfee said the age of the alleged victim can be a determining factor in whether super aggravated sexual assault applies as well as the circumstances of the alleged assault.

“All sexual assaults are horrible, egregious acts — don’t misunderstand,” he said. “We’re talking about (a victim) under the age of 6.”

Aggravated sexual assault of a child applies when the alleged victim is 14 or under, but McAfee said if the perpetrator causes bodily injury or threatens the victim with death, serious bodily injury or commits the act during a kidnapping, then the state can pursue the super aggravated sexual assault of a child as well.

“(It shows) Texas isn’t going to tolerate this,” McAfee said.

In a probable cause affidavit, the Ranger stated that, during a search of the suspect’s residence in Cottonwood Shores, investigators found a computer.

During an interview with the suspect, Phillips stated in the affidavit that DeLancey “confessed” to sexually assaulting the child and making a video recording of the alleged incident. The suspect even told investigators where the recording was located on his computer, according to the affidavit.

The three other charges are second-degree felonies punishable from two to 20 years in prison.

Up to the time of his arrest, DeLancey worked for the Marble Falls Independent School District technology department. When law enforcement alerted district officials of Delancey’s arrest, MFISD dismissed him.

BURNET — A 21-year-old man was charged with murder after Burnet County deputy investigators found the bodies of two men at a residence in the 5800 block of CR 340.

Authorities booked Garrett James Ballard into the Burnet County Jail on a charge of capital murder of multiple persons in regards to the alleged shooting of two individuals. Burnet County deputies responded to the residence at 6:16 a.m. Aug. 19 for a welfare concern call.

Once on the scene, however, the deputies found two dead men — Elijah Adam Benson and Travis Leslie Fox — at the residence. Burnet County Sheriff W.T. Smith said both victims had been shot with at least one man shot multiple times.

The bodies were found outside the residence — one at the bottom of some stairs and the other near a vehicle.

Smith said investigators also recovered a rifle they believe was used in the shooting. The sheriff said he didn’t know the motive behind the alleged murder at this time, but the investigation is still under way.

Texas Rangers and members of the Texas Department of Public Safety Crime Scene Unit along with the 424th/33rd District Attorney’s Office are assisting with the investigation.

BURNET — The suspect in a Burnet County double homicide apparently used a law enforcement officer’s rifle in the alleged murder of two men at a residence Aug. 19.

The suspect, identified as Garrett James Ballard, 21, is the son of Burnet County Precinct 3 Constable Jimmy Ballard, according to Burnet County Sheriff W.T. Smith.

Burnet County deputies and the Texas Rangers charged Garrett Ballard with the murder of Elijah Adam Benson, 17, and Travis Leslie Fox, 26, after the three men allegedly used hallucinogenic drugs, according to an arrest warrant affidavit sworn out by Investigator Robert Clark and signed by Burnet County Precinct 1 Justice of the Peace Calvin Boyd.

Burnet County deputies responded to a residence in the 5800 block of CR 340 at 6:16 a.m. Aug. 19 where they discovered the bodies of Benson and Fox. Smith said both men suffered from what appeared to be gunshot wounds. He added that investigators had recovered the suspected weapon — a rifle — at the scene.

According to the affidavit, Garrett Ballard told investigators he, Benson and Fox wanted to celebrate a birthday on Aug. 18 and at sometime purchased some “acid” from another acquaintance. Then the three went to the suspect’s residence to use the drugs.

Garrett Ballard told investigators “that as the narcotic hallucinogen took affect, strange and disruptive behaviors were exhibited by Fox and Benson,” according to the affidavit.

At some point, the suspect got the keys to his father’s patrol unit and retrieved the .223-caliber rifle from it and then loaded it, the affidavit stated. As he stood by the patrol unit with Benson nearby, Garrett Ballard told investigators Fox came out of the house “exhibiting erratic behavior.” Garrett Ballard then shot Fox, according to the affidavit.

Benson apparently began losing control at this time due to the unfolding situation. Garrett Ballard told investigators that, “for unknown reasons,” he aimed the rifle at Benson and shot him, according to the affidavit.

The suspect told Clark and Texas Ranger Jason Bobo that he then left the residence and went to his girlfriend’s home and told her what happened. The suspect also contacted his sister and spoke with her husband, who is also a police officer. He then told investigators he did contact his mother and father, according to the affidavit.

Officers booked Garrett Ballard into the Burnet County Jail on a charge of capital murder of multiple persons.

Video nabs suspect in Granite Shoals credit card abuse

GRANITE SHOALS — Authorities charged a woman with credit card abuse against an elderly person after a couple identified the suspect on surveillance video making several purchases with their card, according to a report from Granite Shoals police.

Amanda Hiesler, 39, faces 33 counts of the charge, which is enhanced from state jail to third-degree felony due to the ages of the alleged victims.

The charge is punishable by up to 20 years in prison with a conviction on each count.

“We were contacted by an elderly couple who discovered a number of fraudulent charges on their credit card, said Granite Shoals Police Capt. Gary Boshears.

“We got some surveillance video from some of the stores where the purchases were made,” he said. “The victim was able to identify her off watching a couple of those transactions, and then she admitted to conducting the rest of the transactions in Granite Shoals.”

The woman had been employed by the couple, who are in their 70s, Boshears said.

About $500 worth of items including alcohol, cigarettes and food were purchased at Granite Shoals stores using the credit card between the fourth week in July and the second week in August, the report stated.

The investigator believes additional transactions occurred in Kingsland and Marble Falls.

Hiesler was booked into the Burnet County Jail on Aug. 18 and released on Aug. 22 on bond.

Kingsland woman charged with murder in death of 23-year-old man

KINGSLAND — Authorities have charged 46-year-old Kathryn Louise Preston with murder in connection with the death of 23-year-old Jose Mario Hernandez following a homicide investigation at a private residence in the River Oaks neighborhood, according to a statement by the Llano County Sheriff’s Office.

According to the statement, the Kingsland couple appeared to have been in a “relationship for two to three years.”

Authorities say they received a 911 call at 9:29 a.m. Aug. 26 at the residence in the 200 block of McGee Trail.

When they arrived, they found a “deceased male inside.”

Results of an autopsy by the Travis County Medical Examiner’s Office are pending. The murder charge is a first-degree felony punishable by five to 99 years or life in prison with a conviction. Preston remains in the Llano County Jail on a $500,000 bond.

KINGSLAND — Officials with the Llano County Sheriff’s Office say they are awaiting the results of an autopsy in a possible homicide investigation under way Aug. 26 in the River Oaks neighborhood.

Sheriff Bill Blackburn said he is not immediately releasing details about the incident but confirmed investigators are at the scene of a private residence in the Kingsland area.

KINGSLAND — A 46-year-old woman charged with the murder of a man Aug. 26 told investigators the man hit his head on a rock, but law enforcement officers found the body wrapped in a blanket and “set on fire.”

According to a probable cause for arrest document, Kathryn Louise Preston told Llano County Sheriff’s Office Deputy Kirk Jowers the alleged victim, 23-year-old Jose Mario Hernandez, had abused her. She also claimed the man, whom she described as her husband, had hit his head on a rock.

Emergency crews and deputies initially responded to a residence in the 200 block of McGee Trail in Kingsland at 9:16 a.m. Aug. 26.

According to the affidavit, the two deputies were dispatched to the residence for a fire and possible injuries.

When Jowers and Deputy Steven Sifford arrived, they found Preston sitting in the backyard. She told the deputies about the alleged abuse and said Hernandez was on the bedroom floor.

“Kathryn stated that her husband hit his head on a rock,” the document stated.

The deputies found Hernandez’s body wrapped in a blanket in the bedroom but also discovered someone had allegedly set it on fire.

“There was a large piece of concrete next to his body,” Jowers wrote in the probable cause document. Both deputies “observed” an injury to Hernandez’s head, the affidavit added.

Deputies eventually charged Preston with murder, a first-degree felony, and booked her into the Llano County Jail, where she was being held on a $500,000 bond. A first-degree felony is punishable by up to 99 years in prison.

The Travis County Medical Examiner’s Office conducted an autopsy of the man’s body Aug. 27. The Texas Rangers and Texas Fire Marshall’s Office are assisting the sheriff’s office with the investigation.

Marble Falls police charge broken-hearted man with break-ins

MARBLE FALLS — When a Sana Vida staff member arrived at the business at about 6 a.m. Aug. 20, he noticed a man lying near the front door holding a crow bar in his hand.

It was the start of a trail that led police investigators through several alleged burglaries and a robbery in Marble Falls. And the man, who was unresponsive when officers arrived on the scene, eventually told investigators after another arrest that his alleged destructive field trip started when his girlfriend broke up with him.

Marble Falls police contacted Marble Falls Area EMS, which then transported the man, identified in an arrest warrant affidavit as Murl Shane Lamb, 40, to Seton Highland Lakes “for a possible drug and/or alcohol overdose.” After turning over the man to EMS, officers located more buildings in the area they believed the suspect might have burglarized.

The owner of the Sana Vida facility put the damage to the business at $15,000.

But it was an alleged robbery Aug. 21 at a convenience store in the 800 block of U.S. 281 in Marble Falls that brought it all together when officers arrested and charged Lamb. According to an arrest warrant affidavit, the suspect agreed to speak with officers regarding the Aug. 20 activities as well as the alleged robbery.

On Aug. 20, Marble Falls officers also investigated an alleged break-in at the Marble Falls Church of Christ, 711 Broadway. Upon arriving at work, a church staff member noticed someone had apparently forced his or her way in through a window. The staff member also reported damage to many interior doors and several open cabinets in the church.

An officer investigating the church break-in believed the pry marks at the scene resembled those made from a crow bar or a claw hammer, according to the affidavit.

Officers also responded to a possible burglary at a building and shed in the 1000 block of Avenue F in Marble Falls.

During the interview with the suspect, the man allegedly confessed to the spree of burglaries as well as criminal mischief activity, according to the affidavit, which was signed Sept. 2.

He told investigators his girlfriend had recently broken up with him, so he began using methamphetamines and added that he had not eaten or slept in five days, the affidavit stated.

Though he was unable to remember much of the details surrounding the alleged burglaries and criminal mischief because of the drug use, the suspect claimed he was looking for cash, according to the affidavit.

Marble Falls police charged the man with robbery, two counts of burglary of a building and criminal mischief. He also faces aggravated robbery charges out of Llano County. He was booked into the Burnet County Jail and is being held on a total $315,000 bond.

HORSESHOE BAY — A man has turned himself in after an investigation involving a pickup truck crashing into a house on Labor Day, according to Horseshoe Bay police.

Isidro Avalos Ramirez, 53, of Horseshoe Bay left the scene of the accident but was located and placed in jail two days after his 2005 F-250 pickup left the roadway and struck the house Sept. 1 in the 5300 block of FM 2147 West, according to a Horseshoe Bay police report.

“He was issued citations for unsafe speeds, no driver’s license and failure to maintain insurance (on Sept. 2),” Police Chief Bill Lane said. “He did not give a reason why he left (the scene).”

Authorities obtained an arrest warrant after questioning him on a class B misdemeanor charge of leaving the scene of the collision. He turned himself in Sept. 3.

The homeowner who had returned about an hour later found the pickup lodged inside the extended garage area about 11 p.m. that night.

“The damage is extensive,” Lane said. “The owner felt like he would be upwards of $100,000 but is still waiting for the insurance estimates for the exact figures.”

Ramirez suffered minor injuries, according to the report.

“The individual told us that his brakes had gone out,” Lane said.

Ramirez was taken to the Llano County Jail and transferred to the Burnet County Jail, where he remains on a $2,500 surety bond.
